This website is created free from wix.com yet showcases artworks created by Naresa Dizon ("The Artist" or "Artist" or "I" or "my" ) based in Guiguinto, Bulacan, Philippines, thus is defined as the artist's online portfolio. 
 

Definitions

“The Artist” or "I" or "my" -  Naresa Dizon
“Visual Assets“ or "Assets" "Creation/s"- means any work, images, animations, video content in any medium or form including (but not limited to) 2D image files, Game User Interface, Sprites, Background, etc.
“Game/s”- means any digital or media product, creation or platform of a customer including (but not limited to) software, applications, video and audio content, document and websites.
“Client/s” or  “Owner/s” or "Customer/s" – is an individual or company who accepts and hired Naresa Dizon under a contract as an artist to create original visual asset for their own game.
"Portfolio" - this website and it's content. Provided to any potential client to showcase the artist's work experience and skills.

Intellectual Property

The visual images are created by the artist, but the ownership and property are owned by the clients. The artist may or may not show her work publicly depending upon what the artist and the client agreed in the contract written, agreed and signed between the two parties. If the artist can finally showcase her creations within the limits of their contract, the artist can only claim as the creator and not the owner for the sole purpose of showcasing this portfolio. It's is the clients' duty to protect and claim ownership with copyright, trademark, and other laws from their own/any country.

Alteration and Modification
The client/s can alter, change and modify any assets given and provided by Naresa Dizon. The artist do not have the power to dictate the art design and other art properties if the client wishes to modify, edit or alter assets provided by the artist. As such, what is visible in this portfolio can appear modified or edited in the game, their advertising materials or any product they wish to make out of the assets provided by the artist.

It is strictly prohibited for any person, company, group, visitors, excluding the clients to modify, alter or any form of plagiarism, the visual arts presented in this portfolio.

Typographical Errors
In the event that the artist's client/s, visual assets, and other information mistakenly listed at an incorrect spelling, Naresa Dizon honors the contract that the two parties signed separately apart from this service. This website's purpose is strictly for portfolio usage and not as a proof to discredit, dishonor, or attack her clients or the game by claiming it is not the owners' property or any form of harm due to typographical errors. The property is strictly protected by the contract signed between the two parties.

Naresa Dizon. has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. I do not warrant the offerings of any of these entities/individuals or their websites.

Indemnification

You agree to defend, indemnify and hold harmless Naresa Dizon and her clients from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
 

Limitation Of Liability

In no event shall Naresa Dizon nor her clients be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Use of Site
Harassment in any manner or form on the site, including via message, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including Naresa Dizon or other licensed clients, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.
 

You may not use this site for the following:

You may not remove any watermarks or copyright notices contained in the Content or product images displayed.
In any way that is unlawful or fraudulent or has any unlawful or fraudulent purpose or effect.
To transmit or procure the sending of, any unsolicited or unauthorized advertising or promotional material or any other form of similar solicitation or spam.
Transmitting of any data, send or upload any material that contain viruses, Trojan horses, worms, time bomb, spyware, adware or other programs that can harmful to the computer code.

Other than the client's rights, the use of our site does not grant you any ownership of any content, code, data or materials you may access or any intellectual property rights subsisting any content, code, data or materials you may access.
 

Governing Law

These Terms shall be governed and construed in accordance with the laws of Republic of the Philippines, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
 

Changes

I reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material I will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at my sole discretion.

By continuing to access or use my Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
